Can you be fired for mental health hospitalization?

A colleague of mine had to be hospitalized for a mental health issue recently, and she's very anxious about her job security now that she's back. Can you be fired for mental health hospitalization in India?

Haan na, this is such a stressful situation to think about. Actually, companies cannot just fire you like that for being in the hospital, but many times they make some other excuse to let people go. It is better to have all doctor certificates and leave applications properly submitted on mail so you are safe.

Legally, under the Mental Healthcare Act in India, you have rights, and companies cannot discriminate against you for mental illness. Just like how I keep all my medical files for my thyroid checks, please keep a clear paper trail of your hospital admission and doctor's advice. If they try anything funny, you have the medical proof to back you up.

Honestly, mental health is just like physical health; if you broke a leg and got admitted, they wouldn't fire you, right? Taking care of your mind is crucial, so focus on recovery, eat well, and do light walks when you can. Once you're back, you can deal with HR with a fresh and strong mind.

God forbid anyone should face this stress when they are already unwell. Please don't worry too much about work right now; getting healthy is the most important thing. Have your close family member speak directly to your manager and keep them updated, as clear communication solves half the problems.

Bro, my friend went through a severe depressive phase and had to be admitted for a week. His manager was cool about it, but HR tried to create issues later on. He got a proper doctor's note and threatened to escalate it legally, and they backed off immediately. Don't let them bully you.

Arre, in our times we didn't even have a term for this, we just called it a 'long vacation' to escape the boss! But jokes apart, the law is on your side now. Just make sure your family sends the formal medical leave email to HR on day one so the company doesn't claim you went missing from work.
